PFT: EJ Manuel goes to Bills at No. 16, first QB taken

Jarvis+Jones+Georgia+v+Auburn+GMLXkEopP5vlGetty Images

The Steelers added a young outside linebacker to bolster their pass rush and help replace the departed James Harrison, selecting Georgia?s Jarvis Jones No. 17 overall on Thursday night.

Jones (6-2, 245) notched 14.5 sacks in 2012 for the Bulldogs. If Jones is to push for a starting role as a rookie, it would likely be at the expense of veteran Jason Worilds.

That said, the Steelers generally don?t rush their rookies into the lineup. They have to earn their way onto the field. Maurkice Pouncey played in his rookie season of 2010 because he was too good to sit, and guard David DeCastro looked poised to be a Week One starter before a knee injury last summer.

?Quite honestly, I don?t envision anyone coming in and being an impact in Year One,? Steelers GM Kevin Colbert said this week, according to the club. ?I never do because I think there is always a growing process that has to occur.?

It can take time for Steelers? outside linebackers to master Dick LeBeau?s defense. LaMarr Woodley, it should be noted, did not start as a rookie in 2007. If Jones can at least be a solid situational rusher (a la Woodley as a rookie) and pick up the defense, he will have done well, considering how other rookies have fared with this veteran-laden club.

The Samsung Galaxy S IV Reviews Are Great for the HTC One

With the Samsung Galaxy S IV set to go on sale this weekend on AT&T and in another month on Verizon, the reviewers have taken the purported iPhone killer for a spin and despite all its bells and whistles, they still like another Android phone a lot better. At its very dramatic Radio City debut, Samsung announced the successor to its very popular Galaxy S III, which included what looked like a few too many bells and whistles. And, it turns out, all the extra features weigh down an otherwise solid device, which means it a good phone, but not a "game changer," to use the words of Walt Mossberg over at AllThingsD. But, there is an Android "game changer" that almost all the gadget nerds brought up while reviewing the latest Galaxy S IV: The HTC One.?

RELATED: Samsung Takes the Secret-Gadget-Announcement Schtick Too Far

Looking for contrived, useless add-ons? The Galaxy S IV is the device for you, says Mossberg:?

If you?re a nut for lists of new features, love Samsung or crave an even bigger display, the Galaxy S 4 may be for you. It?s a good phone, just not a great one.

Not even the geeks are quite sure that's what they want out of a phone, admits Engadget's Brad Molen:

While our geek senses keep tingling at the thought of so many market-topping specs contained within the same chassis, we also aren't?overjoyed, per se, with excitement. The design doesn't feel fresh, especially not next to the HTC One, but we can't deny that it's an improvement over the GS3.

TechCrunch's Jordan Crook is certain it's not what he wants:

At the end of the day, it?d be foolish to think that the Galaxy S4 isn?t a top-notch phone. Where specs, performance and software innovation are concerned, the company is clearly making strides. But in playing with this phone for a while, adjusting to the new features, trying to make the most of them, and sometimes failing miserably, I keep returning to the idea of ?Keep it simple, stupid.?

If all the swiping and eye recognition stuff appeals to you, know that those things only work in Android's "crummy" browser, explains Wired's Michael Calore:

But all that business of waving your hand or moving your eyes to scroll while reading ? it only works in the crummy Android browser. It does not work in Chrome, where I do all of my browsing. It doesn?t work in Google Reader or Flipboard or Instapaper or the Kindle app, where so much reading happens. Looking away from the screen doesn?t pause a video in YouTube, only in the Samsung video player.

If you can get past that, however, this phone has a lot to offer, argues Ars Technica's Florence Ion:

None of this takes away from the performance of the Galaxy S 4, though. It's an?extremely?solid phone, and it's going to be hard to go back to the S III after a week with this one. It feels great to hold, it's comfortable to use throughout the day, and it takes much better photos than its predecessor. The aluminum ring on its chassis makes the handset look more modern than its predecessors. The display doesn't hurt either?it's really something to look at. Samsung definitely has another hit on its hands.

Although, it's build is a bit chintzy, counters Steve Kovach over at Business Insider:

As long as you don't mind a bunch of plastic, you'll be perfectly happy with the Galaxy S4.?

Ultimately, though, if you're in the market for an Android phone,?The Verge's David Pierce suggests?you?consider the HTC One:

The Galaxy S4 is fast and impressive, but it's also noisy and complex. The One is refined, quiet, comfortable, beautiful, and above all simply pleasant. I love using that phone, in a way I haven't experienced with anything since the iPhone 5. That's why, when my contract is up in June, I'll probably be casting my lot with HTC instead of Samsung.

... as does Mossberg:

I urge readers looking for a new Android smartphone to carefully consider the more polished-looking, and quite capable,?HTC One, rather than defaulting to the latest Samsung.

... as does The New York Times's David Pogue:

And the S4 is still made of plastic ? lightweight and grippy, but not as classy as the iPhone?s glass or the HTC One?s metal.

... as does Kovach:

But is it the best phone? No. You're still much better off with the iPhone 5 or the HTC One if you like Android.

,,, as does ABC News's Joanna Stern:

I just wish Samsung had put that same attention into the design of the physical phone. The HTC One and the iPhone 5 are simply better-designed and crafted pieces of hardware.

So, yeah, if you're going to get a new Android phone, consider the HTC One.?

Baucus exit could be free-for-all for Mont. Senate

HELENA, Mont. (AP) ? U.S. Sen. Max Baucus' surprise announcement that he won't run for a seventh term could mean a free-for-all for a Senate seat that has not been open since 1978, with a popular Democratic ex-governor and a freshman Republican congressman already showing interest.

Republicans said the open Montana seat helps their chances to gain six seats in 2014 to win a Senate majority. But many Democrats relish a potential early return to politics for former Montana Gov. Brian Schweitzer, who left office in January because of term limits.

Baucus told The Associated Press he made the decision not to run Monday night, even after he raised $5 million for a re-election fight that now won't occur.

He and his wife talked daily about the decision over several months, he said. They're building a new home in Bozeman and Baucus said he is looking forward to spending more time outside of politics.

"You have to do what you think is right for yourself and your family," Baucus said. "Life goes on. There is a time and place for everything."

Supporters lauded Baucus for a political career that spanned five decades, for playing a key role in some of the nation's biggest political debates and being the standard-bearer for the Montana Democratic Party through some very lean times.

But others ? including some liberal detractors ? sensed opportunity, which will likely lead to a boisterous battle to fill the power vacuum.

It didn't take long for Schweitzer's name to surface as a favorite for Democrats, while many Republicans advanced U.S. Rep. Steve Daines as their favorite.

Other possible GOP candidates include Denny Rehberg, the former congressman coming off a bruising and unsuccessful bid to unseat U.S. Sen. Jon Tester, and former Montana Gov. Marc Racicot, who served from 1993 to 2001 and later chaired the Republican National Committee.

Schweitzer, who previously said he's "not senile enough to be in the Senate," on Tuesday sounded as though he were open to the idea of replacing Baucus.

"Some people see a pickup on the side of the road with a flat tire and say that's a problem. I'm the guy that stops and says, 'I'll fix it.' I like challenges. I like positive outcomes," Schweitzer told the AP.

If Schweitzer runs, he would likely be a shoo-in for the Democratic nomination and could even scare away Republican candidates, said Dave Parker, a political analyst at Montana State University.

"Schweitzer's in the catbird seat. It all begins and ends with him. He's the most popular politician in the state right now and if he runs he clears the field on both the Democratic side and the Republican side," said Parker.

Others said regardless of Schweitzer's decision, Republicans are bound to mount a determined campaign ? and spend heavily ? for the open seat.

"It's going to be another real race again. It's an open seat, so no matter what the race starts today," said Craig Wilson, a political analyst at the Montana State University, Billings.

University of Montana political analyst James Lopach predicted a Daines matchup against Schweitzer. He said Daines will find it hard to resist a Senate run ? no matter the opponent.

"He's got to run statewide anyway. Why not run for a six-year position instead of a two-year position? The Senate is more prestigious and more powerful," Lopach said.

Daines' spokeswoman Alee Lockman said the new congressman is giving a run "serious and thoughtful consideration." His office released a statement saying the congressman appreciates Baucus' lifetime of service and that "it is critically important that this seat be filled by someone prepared to change the direction and culture of our nation."

Former U.S. Rep. Rick Hill, who lost to Steve Bullock in November's gubernatorial election, said he will be trying to convince Daines to run.

"He is a new leader with new ideas," Hill said.

Rehberg, who is now a co-chairman of the Washington-based public-strategy firm Mercury/Clark & Weinstock, did not return a call for comment Tuesday.

Two lesser-known Republicans already have announced their intentions to run ? state Sen. Champ Edmunds of Missoula and former state Sen. and gubernatorial candidate Corey Stapleton.

On the Democratic side, EMILY's List President Stephanie Schriock and state Superintendent of Public Instruction Denise Juneau are possible contenders if Schweitzer decides not to run.

Baucus will be joined in retirement by fellow Democratic senators Jay Rockefeller of West Virginia, Frank Lautenberg of New Jersey, Tim Johnson of South Dakota, Tom Harkin of Iowa and Carl Levin of Michigan in announcing his retirement plans.

Republicans Saxby Chambliss of Georgia and Mike Johanns of Nebraska also have decided not to seek re-election next year.

Baucus in recent years has bemoaned the increased polarization in Washington but he said that was not a factor in his decision. Nor was his "no" vote on a gun-control compromise measure that would have expanded background checks, a vote that angered liberals, he said.

"It is just time to move on," Baucus said.

Baucus said he will focus his remaining time in office on tax reform, the farm bill, the North Fork Watershed Protection Act and his plan to expand land protections along the Rocky Mountain Front. Baucus said the health care overhaul that was a signature bill for him ? one that cost him politically back home ? remains important.

"I want to make sure health care is implemented, and implemented very well," he said.

That health care debate dinged his approval ratings, but Baucus believes the measure will eventually be popular. Baucus recalled a conversation he once had with former U.S. Sen. Mike Mansfield ? a legendary Montana political figure. Baucus said when he was new to politics he was trying to tell Mansfield that the voters would reward them for "doing the right thing."

"He looked at me and just said, 'Yep, but sometime it takes a long time,'" Baucus said. "The bottom line is, it is important for me that Montanans know how grateful I am, and how humbled I am to have served Montana."

Australian police arrest senior member of LulzSec hacking group

By Jane Wardell

SYDNEY (Reuters) - Australian Federal Police have arrested the self-proclaimed leader of the international hacking group LulzSec, the collective that claimed responsibility for infiltrating and shutting down the CIA website.

Police said the 24-year-old IT worker, who held a position of trust at an international company, was arrested in Sydney on Tuesday evening and charged with hacking offences that carry a maximum penalty of 10 years.

Glen McEwen, manager of cyber crime operations at Australian Federal Police, said the man was detained at work, where he had access to sensitive information from clients including government agencies.

LulzSec, an offshoot of the international hacking group Anonymous, has taken credit for hacking attacks on government and private sector websites, including the Central Intelligence Agency (CIA), Sony Pictures, a unit of Sony Corp, 20th Century Fox and Nintendo.

Anonymous - and LulzSec in particular - became notorious in late 2010 when they launched what they called the "first cyber war" in retaliation for attempts to shut down the Wikileaks website.

The name LulzSec is a combination of "lulz", another way of writing "lols" or "laugh out loud", and security.

Australian police said the unnamed Australian man, who used the online moniker "Aush0k", was known to international law authorities.

His arrest comes a week after an American member of LulzSec, Cody Kretsinger, was sentenced in a Los Angeles court to a year in prison followed by home detention. Kretsinger, who used the online handle "Recursion", pleaded guilty in a plea agreement with prosecutors.

Court documents in that case revealed that Anonymous leader "Sabu", whose real name is Hector Xavier Monsegur, had provided the FBI with information on fellow hackers after pleading guilty to hacking offences.

The Australian hacker has been charged with two counts of unauthorized modification of data to cause impairment and one count of unauthorized access to a restricted data system after a government website was attacked earlier this month.

"Let me make it extremely clear to everybody out there, this is not harmless fun, this is serious," McEwen said at a press conference.

McEwen said the man posted in online forums frequented by other members of LulzSec that he was the group's leader.

"There were no denials of his claims of being the leader," McEwen told reporters.

The man has been granted bail and will appear before a court next month.

LulzSec allegedly broke into Australian government department and university websites in 2011. Anonymous last year took around 10 Australian government websites offline, protesting plans to force ISPs to store more user data and make it available to security services.

BlackBerry Q10 review

DNP BlackBerry Q10 review

You can't please everybody all the time, and if there's a company who knows this better than the rest, it's BlackBerry. At the showy launch for BlackBerry 10, the company finally unveiled its new stable of smartphones with which it would fight the likes of Apple, Samsung, HTC, Microsoft, Nokia and Google. No simple task, that, and so BlackBerry rolled out not one, but two weapons: the all-touch Z10 and the portrait-QWERTY Q10.

But there was a catch: only one would launch at a time. It was a staged attack, with the Z10 forming the initial volley. This, many said, was a mistake, and that the Q10 and its familiar physical keyboard should have gone first, paving the way for the more radical, all-touch Z10. After what seems like an eternity, the $249 BlackBerry Q10 is finally ready for duty, so let's put it through its paces and see which of these fraternal twins is truly the flagship.

Pulled Pork Sliders (Sammies)

Ingredients

3-5 lb Boston butt pork roast
28 oz can fire roasted diced tomatoes
2 12 oz cans Coke
1 1/2 c. brown sugar
3 T.. chili powder
12 sandwich buns, split

Directions

1-Place pork in a slow cooker and all the ingredients except the bungs.
2-Cover and cook on low setting for 8 hours.
3-Stir?occasionally?and cook until very tender.
4-Serve on buns and add sauce from slow cooker.

Pork Shred Tip-- If pork is tender, take 2 forks and pull it apart. I love this and use it all the time for shredding meat. This way you can do it while the meat is still hot and you don't have to touch it.

Kitchen Notes-
-My experience is that only 1 can of Coke was needed. My store was out of the butt pork roast so I just purchased the same meat amount pork roast. I get the pork roast that has fat on it just like the butt pork. If not the pork will be on the dry side.
-We served ours with the mini?Hawaiian?buns and a slice of cheddar cheese.
-This recipe made a HUGE amount of meat. We used the leftover the next day for our famous pork aka Pig Nachos.
-Yum!

Attorney: Scant evidence in Mississippi ricin case

OXFORD, Miss. (AP) ? Federal authorities have scant evidence linking a Mississippi man to the mailing of ricin-laced letters to the president and a senator, his attorney says.

Christi McCoy said after a court hearing Friday that the government has offered no evidence to prove her client, Paul Kevin Curtis, had possession of any ricin or the seed from which it is extracted ? castor beans. An FBI agent testified during the hearing that he could not say if investigators had found ricin at Curtis' home, and McCoy said the evidence linking the 45-year-old to the crime so far has hinged on his writings posted online.

He is adamant that he did not do this, and she said she has seen nothing to prove him wrong.

Curtis was ushered into the courtroom before the hearing began in an orange jail jumpsuit and shackles. He turned to face a young woman in the audience before the hearing and whispered, "I didn't do it."

Prosecutors had wanted to delay the hearing because searches of Curtis home and car had not been completed and DNA and other tests are pending.

Curtis' brother Jack Curtis and 20-year-old daughter Madison Curtis watched the court proceeding and said afterward they are not convinced he did what he is accused of, even though they tried to keep an open mind about what would be presented.

"After hearing what I heard in this courtroom, it appears to me that the reason I haven't been provided any evidence is there appears to be none that would link my brother directly to the charges that have been made," Jack Curtis said after the hearing.

So far, Curtis is the primary focus for investigators and the only person arrested in connection with sending those letters and a third threatening letter mailed to a judge. But during a hearing Friday, FBI agent Brandon M. Grant testified that authorities were still trying to determine whether there were any co-conspirators.

As the hearing went on for roughly two hours, Grant said under questioning by Curtis' attorney that he could not say whether any ricin had been found at Curtis' home because the investigation was ongoing. Investigators had found a package they were interested in, but Grant said he did not know what was in it.

Grant also testified that there was one fingerprint on the letter sent to the judge, but that it didn't match Curtis. He said several people handled the letter, and DNA and other tests are pending.

Curtis' lawyer peppered the agent with questions in an attempt to show the government had little hard evidence, but Grant said people's lives were at risk and it wasn't like a fraud investigation in which authorities could gather more evidence before making an arrest.

Family and acquaintances have described Curtis as a caring father and enthusiastic musician who struggled for years with mental illness and who was consumed by trying to publicize his claims of a conspiracy to sell body parts on the black market.

Curtis is an Elvis impersonator and performed at parties. Friends and relatives also say he spiraled into emotional turmoil trying to get attention for his claims of uncovering a conspiracy to sell body parts on the black market.

Grant testified that Curtis' family had become increasingly concerned by his behavior.

Grant said Curtis' ex-wife told authorities that he fought with his daughter around Christmas and told her, "Maybe I should go ahead and kill you."

Madison Curtis said after the hearing that she loves her father and stands by him.

Grant also testified that Curtis' ex-wife said Curtis once told her that he was in hostage situation in Chicago after a breaking up with a former girlfriend, threatened suicide and shot a gun in the air.

However, the agent said they haven't been able to find a record of that.

Grant's testimony ended Friday evening, but the hearing is set to continue Monday morning.

In court documents, Curtis' attorney, Christi McCoy, gave some details of Curtis' arrest. Curtis had gone to get his mail outside his home and was planning to go to his ex-wife's home to cook dinner for her and their children when he was approached by officers in SWAT gear, she wrote. He was then interrogated at an FBI office for several hours, handcuffed and chained to a chair.

Curtis cooperated to the best of his ability, but when he suggested he might need a lawyer, an agent discouraged that, McCoy wrote.

According to an FBI affidavit, the letters he sent read: "Maybe I have your attention now even if that means someone must die."

Officials have confirmed that the letters contained ricin.

While the toxin can be extremely lethal in its purest form, experts say more crude forms are relatively easy to make.

The FBI has not yet revealed details about how the ricin was made or how lethal it may have been. It was in a powdered form inside the envelopes, but the FBI said no one has been sickened by it so far. A senate official said Thursday that the ricin was not weaponized, meaning it wasn't in a form that could easily enter the body.

More than a dozen officials, some wearing hazardous materials suits, were searching the home Friday where Curtis was arrested in Corinth, Miss. FBI spokeswoman Deborah Madden would not say if authorities have found ricin or materials used to make it in Curtis' home, and officials have not provided details about how Curtis may have either obtained or made the ricin.

Curtis' ex-wife has said he likely didn't have the know-how to make ricin, and she did not know where he would buy it because he was on disability. But Cohen said ricin was once known as "the poor man's bioterrorism" because the seeds are easy to obtain and the extraction process is relatively simple.

"Any kid that made it through high school science lab is more than equipped to successfully make a poison out of this stuff. Any fool can get recipes off the Internet and figure out how to do it," Cohen said.

Those seeds, which look a bit like coffee beans, are easy to buy online and are grown around the world; they are often used to make medicinal castor oil, among other things. However, using the seeds to make a highly concentrated form of ricin would require laboratory equipment and expertise to extract, said Raymond Zilinskas, a chemical and biological weapons expert.

"It's an elaborate process," he said.

Russia says U.S. must do more to address missile shield concerns

By Steve Gutterman

MOSCOW (Reuters) - Russian officials said on Thursday the United States had not done enough to address their concerns about an anti-missile shield it is deploying in Europe, indicating U.S. moves to scale down its plans will bring no quick breakthrough.

Their remarks suggested missile defense will remain a bone of contention in relations, increasingly strained since Vladimir Putin returned to the Russian presidency last May.

They indicated there had been no major progress during a visit on Monday by President Barack Obama's national security adviser Tom Donilon, who met Putin in the highest-level contact since Obama began a new term in January.

"There is still time to search for a solution to this problem, but it requires political will, and so far this has not been apparent in sufficient measure from the American side," Deputy Foreign Minister Sergei Ryabkov said at a discussion with Russian policy analysts.

The Pentagon said last month it would station additional missile interceptors in Alaska in response to North Korean threats and at the same time forgo a new type of interceptor that would have been deployed in Europe as part of the shield.

RUSSIA WANTS GUARANTEES

NATO and U.S. officials have expressed hope that the change could help end the standoff by removing what Russia has called its main concern: that the system's interceptors could shoot down its long-range nuclear missiles.

But Ryabkov repeated Russia's demand for "firm legal guarantees" that the shield, which consists of interceptor missiles and radar systems and is to be completed by about 2020, is not intended to shoot down Russian missiles and cannot do so.

The United States and NATO, which is cooperating on the shield, have refused to provide such guarantees, which would be virtually impossible to get past U.S. lawmakers because of concerns about giving Moscow a veto on missile defense plans.

The allies say the shield is designed to protect against potential threats from Iran and poses no danger to Russia.

Some Western diplomats suspect the Kremlin has been using its concern over the European missile shield as a bargaining chip and will continue to do so.

Russia has indicated it is unlikely to agree to further cuts in long-range offensive nuclear weapons, beyond those agreed in the 2010 New START treaty with the United States, if its concerns about missile defense are not addressed.

Deputy Defense Minister Anatoly Antonov, who spoke after Ryabkov at the discussion, said Russia needed binding guarantees about the U.S. shield because there was a risk it could change its plans in the future.

"The Americans always say, 'Aw, forget about your guarantees - let's start cooperating, and as we cooperate you'll see how harmless our system is,'" Antonov said. "We are not prepared to do things that way."

Real Estate Marketing Strategies: Overcoming Blocks to Lead ...

by Dr. Maya Bailey

Now more than ever people are struggling with lead generation and looking for solutions. Most real estate agents feel blocked when it comes to picking up the phone and calling prospective clients.

When you got into real estate, you didn't really get into real estate so that you could call up strangers on the phone and see if you could interest them in your services. You got into real estate because you love to help people buy and sell homes.

You have two businesses. One, the business that's easy for you, helping people buy and sell homes, working with contracts, negotiating with buyers and sellers and so forth. The second business you have that you haven't wanted to address is the business of lead generation, or prospecting.

Most people don't want to address this part of their business because it's just plain scary. The idea of setting aside two hours a day every day to call people you don't know makes most real estate agents get very anxious. Then they find things to do instead of lead generation like busy work. This is called AVOIDANCE.

The challenge is for you to admit this but without judgment or blame.

Most of you have been avoiding lead generation for quite some time. And by avoiding I don't mean that you've avoided it altogether, it's just that you've been doing it inconsistently and you're noticing that it isn't enough. Making a few calls a day can hardly be called lead generation. Gary Keller says in his new book Shift, "you can't sit back -- you must be more rigorous and resolute in your lead generation than ever before and more so than anyone else."

Agents who are succeeding in today's market are diligently prospecting up to three hours a day. Here are some common misconceptions that most real estate agents carry that keep them from effectively generating leads:

  1. 1. Time: the first misconception that real estate agents have is that they don't have enough time to add lead generation into their schedule. By working on your time management skills, perhaps getting up a bit earlier, or re-arranging some of your routine, you can find 2-3 hours every morning for prospecting.
  2. "I won't know what to say", coupled with fear of making mistakes. Keller says that, "prospecting is nothing more than a set of tasks and skills that are well documented." In other words, you can learn what to say, it's not a mystery, you just need to have scripts for different categories of people.
  3. It takes money to make money. Some are afraid lead generation will cost them money and they're already feeling strapped. Lead generation does not require your money, just your time.
  4. Telemarketer misconception. "I really don't like it when telemarketers call me, I always feel interrupted and disturbed. How can I do to someone else what I don't like done to me?"

When you call a client, you are calling to see if they might need some help from you. For example if you call someone in the category of for sale by owners, then you're asking them if they might be able to use your services. Your chances are very high that they can use their services. They didn't realize when they got into selling their home by themselves that it would be such a hassle. Usually they don't succeed and often they will hire a real estate agent to do it for them once they realize the value.

But how can they hire you, unless they know you exist and you're interested in helping them? It's your job as a real estate professional to let clients know that you exist and you have a desire to be of service. In fact the more your leading motivation is to help people, the more that will come across in your conversation.

Don't worry about rejection. You have an expertise in helping people to buy and sell homes. You can be proud of that expertise. When you do lead generation, you're exploring to see if you can find a match for someone who's looking for your expertise. If someone is interested in your services, you found a match. If they are not interested in your services, they are not rejecting you. It simply is not a match. Thank them and move on to the next.

Have you heard the expression, "People don't care how much you know until they know how much you care?" Express your caring and warmth through being in alignment with the intention of your heart, which is to be of service and help people.

Supreme Court Set to Hear Arguments on Whether Human Genes Can Be Patented

As the justices prepare to hear arguments in the Myriad Genetics case, observers are debating the impact of the outcome on personalized medicine and whole-genome sequencing

When Daniel Weaver pitches Genformatic to potential investors, he feels obliged to note a future legal uncertainty. The two-year-old company, based in Austin, Texas, offers whole-genome sequencing and analysis to researchers and physicians, with plans to apply the technology to medical diagnostics. But Weaver fears that the company could become ensnared in a thicket of thousands of patents. ?Who knows how much it would cost in legal fees just to sort through that?? he says.

Weaver and others in his line of business are looking to the US Supreme Court to prune that thicket. On 15 April, the court will hear arguments in a long-running lawsuit intended to answer one question: are human genes actually patentable? Yet the implications of the court?s decision ? expected by the end of June ? may be narrower for business and medicine than many people hope and think. The case is limited to patents that cover the sequence of a gene, rather than methods used to analyze it (see ?A plethora of patents?). ?Symbolically, this case is a pretty big deal,? says Robert Cook-Deegan, a policy researcher at Duke University in Durham, North Carolina. ?But the practical consequences of it are limited.?

The case, Association for Molecular Pathology v. Myriad Genetics, tackles the validity of patents owned by Myriad Genetics, a medical diagnostics company based in Salt Lake City, Utah, on isolated DNA that encompasses the human genes BRCA1 and BRCA2. Certain forms of these genes increase the risk of breast, ovarian and other cancers. Myriad says that its patents are necessary to protect its investment in research. But physicians and patients charge that the intellectual-property restrictions have limited development of ? and access to ? medical tests based on the genes. In 2009, the American Civil Liberties Union and the Public Patent Foundation, both based in New York, sued Myriad. The case has been rumbling through the courts ever since.

To many in biotechnology, it has ramifications beyond specific genes. The case highlights concerns that a network of individual gene patents could threaten the future of personalized medicine and whole-genome sequencing by blocking companies and clinicians from reporting a patient?s genetic risk factors for different diseases. ?It?s as if somebody had a patent on the X-ray images of the pelvic region of a human being,? says Weaver. ?You could administer the test, but you wouldn?t be able to inform the patient about that region. It?s crazy.?

By some estimates, the number of patents on human DNA is indeed extensive. In 2005, researchers reported that 20% of human genes had been patented. Two weeks ago, another team raised that estimate to at least 41%. But some dispute these numbers and their implications. Christopher Holman, a law professor at the University of Missouri-Kansas City, read through 533 of the 4,270 patents referenced in the 2005 study, and found that more than one-quarter were unlikely to limit genetic testing. ?The literature is full of this kind of problem,? he says.

His analysis was backed up by Nicholson Price, an academic fellow at Harvard Law School in Cambridge, Massachusetts, who found that few, if any, DNA patents would be infringed by companies or clinics sequencing whole genomes of individuals for medical insight. Many, for example, apply only to the selective isolation of specific stretches of DNA, says Price, whereas whole-genome sequencing is an untargeted sweep of the entire genome.

Italy's center-left leader denies party about to split

By Massimiliano Di Giorgio and Steve Scherer

ROME (Reuters) - Italy's Democratic Party (PD) chief Pier Luigi Bersani on Thursday denied an imminent split of his center-left bloc, the largest in parliament, amid increasing criticism of his leadership during a prolonged political stalemate.

The PD is divided over whether to join forces with its center-right rival Prime Minister Silvio Berlusconi, who says a "grand coalition" is the only way to break the political impasse caused by February's inconclusive national vote.

Bersani has repeatedly ruled out an alliance with Berlusconi, an unpalatable figure for many PD voters, but high-ranking party officials increasingly argue that the party must open a dialogue with the 76-year-old media tycoon.

The February 24-25 election gave the center left control of the lower house but not the Senate, where only an alliance with Berlusconi's center right or Beppe Grillo's 5-Star Movement would permit the formation of a government.

The PD chief's attempts to woo the anti-establishment 5-Star Movement failed and he now hopes to be able to form what would in effect be a minority government tolerated by rival parties.

The strategy has come under criticism, however, with Rosy Bindi, the party president, telling the daily La Stampa newspaper on Thursday it would allow Berlusconi to pull the plug on the government whenever he wished.

"We'd be putting ourselves entirely in his hands," she said.

Bersani's main rival in the party, Matteo Renzi, the 38-year-old mayor of Florence who lost a primary last year to lead the center-left in the election, has also criticized his leader's strategy, saying that it is wasting vital time.

"They have to hurry up. I personally have said from day one that it would be better to vote again because when there's no clarity, it's better to do it again," he told La7 television on Thursday. "But if they want to get an agreement between Bersani and Berlusconi, they should get on with it."

The dissent has piled pressure on Bersani, a 61-year-old former industry minister, who has been criticized by many in the party by failing to translate the solid opinion poll lead it enjoyed before the election into success.

On Thursday, he dismissed speculation that the party was on the verge of splitting, telling reporters: "We don't have problems of this kind."

PRESIDENTIAL ELECTION

As the stalemate has dragged on, the parties have begun preparing for the next major battle, the election of a new president of the Republic to succeed current head of state Giorgio Napolitano, whose term ends on May 15.

The vote will be vital because with Napolitano's mandate running out, constitutional rules prevent him from dissolving parliament, leaving it to his successor to call new elections if no accord can be found to allow the formation of a government.

Voting by the two houses of parliament as well as by representatives from the regions, will begin on April 18 but may take several days to complete.

Bersani, who met Berlusconi on Tuesday to talk about the presidency, has opened up to talks with the center right to select a new head of state and on Thursday met Berlusconi ally Roberto Maroni, leader of the Northern League party.

Various names have been floated in the press, including former prime ministers Giuliano Amato, Romano Prodi and Massimo D'Alema and former European Commissioner Emma Bonino but all have aroused objections and no clear favorite has emerged.

Separately, Grillo's 5-Star Movement (M5S) opened an online vote to allow supporters to nominate candidates for the presidency prior to a vote on the 10 leading names on Monday.

"The Bed and Breakfast couple, Bersani and Berlusconi, are deciding in their secret salons a deal on the president ruling out any form of popular participation, while the M5S is opening an open and democratic process," Grillo said on his blog.

Possible tornadoes slam Missouri, Arkansas

JEFFERSON CITY, Mo. (AP) ? Storms packing rain, snow and dangerous winds raked the Midwest and spawned a possible tornado outside of St. Louis that prompted an emergency declaration from Missouri's governor.

To the north icy weather left thousands without power and prompted Minnesota Gov. Mark Dayton to call out the state Nation Guard to aid residents as the state braced for another storm system that threatened to dump several inches of wet snow Thursday.

The most violent weather was centered near the St. Louis suburb of Hazelwood late Wednesday night. The St. Louis Post-Dispatch reported early Thursday that homes and vehicles were damaged in the area. There were no immediate reports of serious injuries.

Butch Dye, a hydrometeorological technician with the National Weather Service in St. Louis, Mo., said crews would assess the damage Thursday.

"We won't be able to confirm whether it was a tornado until teams get out there tomorrow," Dye said.

Missouri Gov. Jay Nixon declared a state of emergency in response to the damage in the St. Louis region and power outages in southern Missouri. Nixon plans to survey storm damage Thursday.

In Minnesota, Gov. Dayton said the weather was taxing the resources of local and county governments, and he issued an executive order activating the guard.

The town of Worthington was using backup diesel generators to power sections of the city at a time, public utilities manager Scott Hain told Minnesota Public Radio. Roughly a quarter to a third of the city of about 13,000 people was without power at any given time, he said.

"With the generation that we have available, we are conducting rolling blackouts through the community," Hain said. "From what we're hearing from the folks that own the transmission that's down right now, is we expect that we'll be operating under this same scenario at least through the rest of today and possibly into tomorrow as well."

The National Weather Service said southwestern Minnesota could get 8 or 9 inches of snow by Thursday morning, while 8 to 14 inches was forecast for a large swath of southern Minnesota, including the Twin Cities, St. Cloud, Willmar and Mankato starting Wednesday night and into Thursday.

In Missouri and Arkansas, dangerous winds were the threat Wednesday. A tornado was reported to have touched down near Botkinburg in north-central Arkansas, said John Robinson, the warning coordination meteorologist at the National Weather Service office in North Little Rock. Four people were injured.

Residents in eastern South Dakota were hunkering down Wednesday for the second wave of a spring storm that already downed power lines and closed roads, schools and businesses. Tens of thousands of residents in that part of the state remained without power as they awaited more bad weather.

Freezing drizzle was expected to give way Wednesday night to 6 to 12 inches of snow accompanied by winds of 15 to 25 miles per hour, said Philip Schumacher, a National Weather Service meteorologist.

The weather service said the challenging weather could extend into flood-prone southeastern North Dakota, where about 3 to 5 inches of snow is expected through late Thursday.

Although it could contain at least one-quarter inch of liquid, weather service officials said it should not change the current flood forecast.

"Any additional precipitation at this stage in the game is not necessarily a good thing," said Peter Rogers, a weather service meteorologist in Grand Forks. "But we're not expecting that to have an immediate impact on the rivers either."

In Wisconsin, rain, ice and snow caused minor flooding Wednesday in areas including the Rock River at Afton and Newville, Crawfish River at Milford, Sheboygan River at Sheboygan, and Manitowoc River at Manitowoc.

Wisconsin Emergency Management spokesman Tod Pritchard said another wave of freezing rain could sweep across central Wisconsin from La Crosse to Green Bay from late Wednesday into Thursday. That rain could cause more flooding in the region.

League of Individuals for the Environment, Inc.: Vector-borne ...

tick on a leaf

Vector-borne disease" is the term commonly used to describe an illness caused by an infectious microbe that is transmitted to people by blood-sucking arthropods. The arthropods (insects or arachnids) that most commonly serve as vectors include: 1.) blood sucking insects such as mosquitoes, fleas, lice, biting flies and bugs, and 2.) blood sucking arachnids such as mites and ticks. The term ?vector? refers to any arthropod that transmits a disease through feeding activity.

Vectors typically become infected by a disease agent while feeding on infected vertebrates (e.g., birds, rodents, other larger animals, or humans), and then pass on the microbe to a susceptible person or other animal. In almost all cases, an infectious microbe must infect and multiply inside the arthropod before the arthropod is able to transmit the disease through its salivary glands. The most common vector-borne diseases in Virginia are carried by mosquitoes and ticks.

Ohio judge sentences convicted 'Craigslist' killer to death

By Kim Palmer

AKRON, Ohio (Reuters) - An Ohio judge sentenced Richard Beasley to death on Thursday for the murder of three down-on-their-luck men who responded to an ad he placed on the Craigslist website for a nonexistent job.

Prosecutors had called Beasley a "false prophet," and a con man who manipulated his victims to keep himself out of prison, acting as the mastermind and triggerman in the killings he was convicted of committing along with a teenage accomplice.

"Beasley is a master manipulator even up to today, constantly trying to manipulate and lie," Summit County Prosecutor Sherri Bevans Walsh told reporters afterward, calling it a well-deserved sentence.

After Summit County Common Pleas Judge Lynne Callahan imposed the sentence, Beasley, 53, told her he believed his convictions would be reversed and he would be found innocent.

"I want to make sure you understand: I have killed nobody," said Beasley, who was wearing prison red and white stripes and sitting in a wheelchair.

Beasley has complained of constant neck and back pain from an auto accident and has asked for special mattresses and shoe inserts while in prison.

Beasley was convicted in March of kidnapping and killing David Pauley, 51, of Norfolk, Virginia; Ralph Geiger, 56, of Akron, and Timothy Kern, 47, of Massillon, Ohio.

He was also convicted of the attempted murder of Scott Davis, 49, a South Carolina man who answered the Craigslist ad and was shot in the arm while escaping after meeting Beasley and the teen accomplice, Brogan Rafferty.

The ad had promised a $300-a-week job as a ranch hand in rural Ohio, but the job did not exist.

Beasley and Rafferty were convicted in separate trials. Rafferty was 16 at the time of the crimes and therefore not eligible for the death penalty. He was sentenced to life in prison without parole and plans to appeal his conviction.

Jurors had unanimously recommended that Beasley be sentenced to death. Under Ohio law, the judge had the option of imposing the death penalty or sentencing him to life in prison.

Davis as well as friends and family of the men killed were allowed to speak after the death sentence was imposed.

Davis said he had felt God's presence come over him after he was shot and later when he was walking through the woods looking for help, recalling his painful recovery from the wound. He also told Beasley he planned to attend his execution.

"I will be there as you go, smiling," Davis said.

Afterward, Davis told reporters that Beasley was simply "a liar" when asked about his claim of innocence.

"When he was shooting at me I saw nothing in his eyes," he said.

Debra Bruce, Pauley's twin sister, said her brother had thought the job would provide a fresh start, calling Beasley "an evil and vile person."

Beasley's mother, Carol Beasley, told jurors during the sentencing phase in March to spare her son, who she said was abused physically and sexually as a child - including by a stepfather, who beat him with an extension cord.

The attacks were among a series of incidents in which people advertising goods for sale or responding to ads on Craigslist and other social media have been attacked and killed.

In 2009, a former medical student was accused of killing a masseuse he met through Craigslist. Last year, two men in Tennessee were accused of killing a man and a woman for "unfriending" the daughter of one of the suspects on Facebook.

'Dancing' silicon atoms discovered in graphene

Apr. 3, 2013 ? Jumping silicon atoms are the stars of an atomic scale ballet featured in a new Nature Communications study from the Department of Energy's Oak Ridge National Laboratory.

The ORNL research team documented the atoms' unique behavior by first trapping groups of silicon atoms, known as clusters, in a single-atom-thick sheet of carbon called graphene. The silicon clusters, composed of six atoms, were pinned in place by pores in the graphene sheet, allowing the team to directly image the material with a scanning transmission electron microscope.

The "dancing" movement of the silicon atoms was caused by the energy transferred to the material from the electron beam of the team's microscope.

"It's not the first time people have seen clusters of silicon," said coauthor Juan Carlos Idrobo. "The problem is when you put an electron beam on them, you insert energy into the cluster and make the atoms move around. The difference with these results is that the change that we observed was reversible. We were able to see how the silicon cluster changes its structure back and forth by having one of its atoms 'dancing' between two different positions."

Other techniques to study clusters are indirect, says Jaekwang Lee, first author on the ORNL study. "With the conventional instrumentation used to study clusters, it is not yet possible to directly identify the three-dimensional atomic structure of the cluster," Lee said.

The ability to analyze the structure of small clusters is important for scientists because this insight can be used to precisely understand how different atomic configurations control a material's properties. Molecules could then be tailored for specific uses.

"Capturing atomic clusters inside patterned graphene nanopores could potentially lead to practical applications in areas such as electronic and optoelectronic devices, as well as catalysis," Lee said. "It would be a new approach to tuning electronic and optical properties in materials."

The ORNL team confirmed its experimental findings with theoretical calculations, which helped explain how much energy was required for the silicon atom to switch back and forth between different positions.

Syrian jet fires missile at Lebanese town

BEIRUT (AP) ? Lebanon's official news agency says a Syrian jet has fired a missile that slammed into a house on the outskirts of a Lebanese border town.

The National News Agency says the attack hit the edge of the town of Arsal on the Lebanese side of the frontier on Wednesday. The report said there were no casualties, although the strike did cause material damage.

Lebanon has been on edge since the uprising against Syrian President Bashar Assad began more than two years ago.

Lebanese gunmen supporting opposing sides of the Syrian conflict have frequently clashed in Lebanon, raising concerns that fighting could spread and reignite Lebanon's explosive sectarian mix.

Arsal is a Sunni Muslim town that has backed opposition fighters in Syria. Arms smuggling into Syria is widespread in the area.

China: Four more have H7N9 bird flu

A further four cases of a bird flu virus not previously seen in humans have been reported by authorities in China.

Three women aged 32, 45 and 48, and an 83-year-old man were diagnosed between 19 and 21 March and are critically ill.

There have now been seven confirmed cases of the H7N9 virus, the World Health Organization said. Two people have died.

But the WHO says there is no evidence of human-to-human transmission.

However more than 160 people who have had contact with the individuals are being closely monitored.

So far, none has developed symptoms.

The latest cases were seen in the Jiangsu province while the earlier cases were in the Shanghai and Anhui provinces.

Two contacts of one of the Shanghai cases who developed symptoms are being retrospectively investigated.

One died and the other recovered, but as yet there has been no laboratory confirmation of whether they were infected with H7N9.

Hygiene measures

The Chinese government has increased disease surveillance, infection prevention and control and communication between human and animal health and industry sectors.

By identifying the source of infection measures can be taken to reduce human exposure?

End Quote Dr John McCauley MRC National Institute for Medical Research

It has advised the population to maintain good personal hygiene, including frequent hand-washing and avoiding direct contact with sick or dead animals.

The WHO is not recommending any travel or trade restrictions.

Dr John McCauley, Director of WHO Collaborating Centre on Influenza at the MRC National Institute for Medical Research, said: "The virus belongs to the A(H7N9) sub-type, a sub-type that has not previously infected humans, and has emerged from the reservoir of avian influenza viruses.

"It is not known how the virus was transmitted.

"By identifying the source of infection, measures can be taken to reduce human exposure.

"The Chinese Center for Disease Control and Prevention is investigating whether there has been any human-to-human transmission."

Tests suggest the virus could be treated with the anti-influenza drugs Tamiflu and Relenza.
